Background
 

The Office of the Banking Adjudicator (OBA) was established in 2002, on the initiative of commercial and merchant banks, the first voluntary scheme in the banking sector in Botswana. The office is an independent body, which exist to resolve legitimate complaints between you and your bank.

We investigate complaints about banking services supplied by member banks of the Bankers' Association of Botswana.

 
Structure
 

The Office of The Banking Adjudicator currently consists of the Banking Adjudicator and he is engaged on a part- time basis. Plans are however underway to recruit a Complaint Resolution Office to assist the Banking Adjudicator.

The Banking Adjudicator reports directly to the Bankers' Association of Botswana.


 
Profiles Office Bearers
 

Gabriel A.K Maotwanyane was, appointed as the second Banking Adjudicator in December 2005 following the retirement of Dr Derek Hudson.

Mr Gabriel Maotwanyane is a Banker and Arbitrator by profession having worked in the financial services sector for more than 20years. He holds various academic and

professional qualifications: Post graduate studies in Business Leadership, an Associate of Botswana Institute of Bankers, Botswana Institute of Arbitrators, and the Chartered Institute of Secretaries and Administrators of Southern Africa.

He is presently a convener of his alma mater and a member of the Botswana Training Authority Banking Standards Task Group.



 
OBA Terms of Reference
 

The Office of the Banking Adjudicator was, established in May 2002, on the initiative of Commercial and Merchant Banks, the first voluntary scheme in the banking sector in Botswana . The office is an independent body, which exist to resolve legitimate complaints between customers and member banks.

The Terms of Reference set out the jurisdiction, powers and duties of the Office of the Banking Adjudicator, and provide a general statement of the procedures to be followed, in filing a complaint against the member banks.

Jurisdiction
 
The Banking Adjudicator may consider a dispute brought by a customer of the Bankers Association Of Botswana.

A private individual

A small business (including a company, corporation an association, a partnership or a trust) with a turnover for the last financial year of P3 million or less.

Financial limitation on claims up to P500,000.00 for direct loss.

P5000.00 for distress and inconvenience.
